By accessing or using LumyxAI ("the Service"), operated at lumyx-ai.site, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

The Service is operated by the LumyxAI team. These terms apply to all users, including visitors, registered users, and API consumers.

2. Description of Service

LumyxAI provides a unified API gateway for accessing various artificial intelligence models. The Service includes but is not limited to:

• Access to AI language models via API endpoints
• An online dashboard for managing API keys, usage, and billing
• A playground interface for testing models
• Documentation and developer resources

3. Account Registration

To use the Service, you must create an account by authenticating through NabzClan. You are responsible for maintaining the security of your account credentials and API keys. You must not share your API keys with unauthorized parties.

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or API keys.

4. API Usage & Rate Limits

The Service enforces rate limits and usage quotas depending on your account tier. Exceeding these limits may result in temporary throttling or suspension of API access. You agree not to:

• Circumvent or attempt to bypass rate limits or usage restrictions
• Use the API to generate content that is illegal, harmful, abusive, or violates third-party rights
• Resell or redistribute API access without explicit written permission
• Use automated systems to excessively burden the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service

5. Credits & Billing

LumyxAI operates on a credit-based billing system. Credits can be obtained through NabzClan VIP subscriptions or purchased directly through the dashboard. Key billing terms:

• Credits are non-refundable once purchased unless required by applicable law
• VIP subscription credits are granted at the start of each billing period and expire at the end of the period
• Credit pricing and model costs may change with reasonable notice
• You are responsible for monitoring your credit usage

6. Content & Output

AI-generated content ("Output") is provided as-is. You are solely responsible for how you use Output generated through the Service. LumyxAI does not claim ownership of your inputs or the resulting outputs.

You acknowledge that AI models may produce inaccurate, biased, or inappropriate content. You agree not to rely on Output for critical decisions without independent verification.

7. Prohibited Uses

You agree not to use the Service to:

• Generate content that promotes violence, hatred, discrimination, or illegal activities
• Create deepfakes, impersonation content, or disinformation
• Harass, stalk, or harm other individuals
• Generate spam, phishing content, or malware
• Violate any applicable local, state, national, or international law
• Infringe upon the intellectual property rights of others

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend or restrict access for maintenance, updates, or security reasons. We are not liable for any downtime or service interruptions.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service, other users, or third parties.

You may terminate your account at any time by contacting support. Upon termination, your access to the Service will cease and any remaining credits will be forfeited.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMYXAI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
